Pretrial Order 44th District Court Dallas, TX
The deadline for discovery requests was
August 6, 2007 and the Plaintiffs abided by that date and submitted their remaining requests
to Defendants by this required deadline.
The Defendants, Dallas-Ft. Worth Metro
Golden Retriever Club (DFWMGRC) and Judy Word, submitted additional
production requests, interrogatories and admissions after the deadline. Defendants submitted
to Plaintiffs on August 10, 2007, additional production requests, interrogatories, and
admissions, well after the stated deadline of August 6, 2007, the date required by Judge Cortez’ Pre-trial
Orders.
In addition, Plaintiffs attorney was first
noticed by Defendant’s attorney on August 23, 2007 for depositions of Plaintiffs to
be taken by Defendant’s attorney. These depositions were tentatively scheduled for
October 16
th
for Alan Meyer and October 17th
for Ellen Meyer.
It clearly
states in Judge Cortez’s Pre-trial Order that Discovery, all depositions
and written
discovery requests shall be served so that responses are due no later than
the date of
September 6, 2007. Trial date was set in his order for November 5, 2007.
According to Judge
Cortez’s original order, Discovery closed September 6, 2007, discovery
requests had to be
served by August 6 2007.
Again,
Defendants had from the time they received the Pre-trial Order signed by
Judge Cortez on
February 20, 2007 to make any discovery requests that Defendants may have had of
Plaintiffs.
However,
Defendants appear to have had no problem filing a Motion to Dismiss, a
Motion for Trial
Continuance, and a No-Evidence
Motion well within the times specified in the Pre-trial Order, and they
appeared at Mediation which was set for August 27, 2007.
Furthermore,
Defendants filed their Motion to Compel against Plaintiffs after Defendants themselves did not fully
complete Plaintiffs’ 1st Production Requests and Interrogatories.
